SMWIA Local 105 and Orange Empire SMACNA implemented a mandatory pre-employment/post-dispatch drug testing program for all signatory contractors in accordance with the decision of the National Joint Adjustment Board.
John D. Michaels & Associates, a third-party administrator, will be facilitating the tests. Drug test collection facilities are listed under the "Drug Testing Locations" tab on this website.
Members will be reimbursed one (1) hour of base wage (without benefits) for the time to take the pre-employment drug test. The reimbursement will be paid at the same time of the first weekly payroll check. Members who fail the pre-employment testing or do not report to work will not be compensated.
If an employee returns to work for the same employer within 45 days of his last day of employment, the employer may elect not to require a drug test.
In cases where the test is found to be positive, the employee assistance program "Beat It" shall be utilized as the first step instead of termination. The TPA maybe be used to adminster this program. Back-to-work agreements shall be utilized when appropriate and at the discretion of the "Beat It" program.
The TPA will forward a list of tested employees along with their monthly billings to the LMCT. The local union will also forward a list of dispatched employees to the LMCT to confirm the monthly billings.
